This Rental Agreement ("Agreement") is made between Common Circus Studios, referred to as "the Venue," and the person or entity making the booking, referred to as "the Client." By proceeding with a booking and checking the acceptance box, the Client agrees to abide by the following terms and conditions of hire.
Nature of Booking:
- Please note that all bookings at Common Circus Studios are subject to approval. If the nature of the booking is not deemed appropriate for any reason, the full amount paid will be refunded to the Client.
- Common Circus Studios is available for hire for creative purposes. Unfortunately, we are unable to accommodate private parties. If you are unsure whether your intended use is appropriate, please feel free to contact us at studios@commoncircus.com.au with any questions.
Bump In & Bump Out Requirements and Accessibility:
- Your booked time includes both setup and pack-up. Please keep this in mind when selecting the length of your booking.
- Access to the studio begins at your booked start time.
- Please ensure that you are packed up, tidied, and ready to leave by your scheduled finishing time.
- Unfortunately, Common Circus Studios is not accessible, as entrance to the studio is via stairs located outside our Hamilton store.
- You may use the carpark next to the Venue.
Pricing:
- 2 Hours (minimum) - $160 + GST
- Half Day (4 hours) - $300 + GST (Morning or Afternoon time slot available)
- Full Day (8.5 hours) - $550 + GST
- Additional hours can be added to your booking at any time, subject to availability.
- Additional hourly rate - $80 + GST
Cancellation:
- You may reschedule your booking by providing 48 hours' written notice to studios@commoncircus.com.au.
- Please note that we cannot guarantee the availability of your preferred reschedule time.
- Rescheduling is permitted within 3 months of your original booking date.
- If you cancel your booking with 48 hours' written notice, you will be refunded 50% of the hire amount.
- Common Circus Studios may cancel the booking at any time before the start of the term by providing written notice to you if we become aware that any event, good, or service to be provided by you at the Venue is dangerous, prohibited by law, or otherwise detrimental to us or our brand's reputation.
Responsibility and Usage:
- Your use of the Venue is at your own risk at all times.
- You agree to comply with our general instructions and directions when using the Venue.
- You must not make any changes or alterations to the Venue without our prior written consent.
- Sub-letting of the Venue is not permitted.
- No more than 6 persons are allowed in the studio without our prior written consent.
- No sales of any kind are permitted without our prior written consent.
- You acknowledge that the Venue is located in a residential area and working space, and all persons attending must refrain from any behaviour that could be reasonably construed as disturbing the neighbours.
- Smoking or vaping is not permitted on the premises.
- If you are issued a door code for entry, it must not be shared with anyone.
- Excessive noise is not allowed; please keep studio doors closed when in use.
- Animals are only allowed in the Venue with prior written consent.
- You agree to notify us immediately of any injury at, or damage to, the Venue arising from your use of the Venue.
End of Term:
- At the end of the term, you must immediately vacate the Venue.
- The Venue should be left in the same condition as you found it, including the removal of all rubbish.
- No food or drink may be left in the Venue.
- All external doors must be closed behind you.
Facilities:
- Although you will have exclusive use of the studio, please be aware that the offices surrounding the studio are leased, and tenants and staff will be on the property.
- You have access to a bathroom and kitchen, but please note that these facilities will be shared with neighbouring tenants. Please be respectful as this is a shared space.
Permits and Insurance:
- It is your responsibility to obtain any necessary permits from the relevant authorities for planned activities or entertainment.
- Clients are responsible for obtaining appropriate insurance coverage for their personal belongings and any activities conducted within the studio.
- Common Circus Studios is not liable and takes no responsibility for any theft or damage to you, your invitees, or property while on-site.
Alcohol:
- You must obtain our prior written approval for any alcohol to be consumed, provided, or sold at the Venue. Approval for the consumption of alcohol may be withheld at our absolute discretion.
- You must comply with all applicable liquor laws at all times. Alcohol is not to be served to guests under 18 years of age.
Liability:
a. Despite anything to the contrary, to the maximum extent permitted by law, we will not be liable for, and you waive and release us from and against, any liability arising from or connected with your use of the Venue.
b. Despite anything to the contrary, to the maximum extent permitted by law, we will not be liable for, and you indemnify us in respect of, any liability that we may suffer or incur or otherwise become liable for, arising from or in connection with:
i. You, your personnel, contractors, or invitees;
ii. Any acts or omissions of you, your personnel, contractors, or invitees;
iii. Any property loss or damage, or personal injury or loss, arising from or in connection with your use and occupation of the Venue; or
iv. Any breach by you of this Agreement.
c. This Clause will survive the termination or expiry of this Agreement.
